1. Acceptance of Terms
By accessing or using ERstat ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ERstat provides:
- Emergency room wait time information from official health authority sources
- Community-reported wait times from users
- Wait time alerts via push notification, SMS, or email
3. Medical Disclaimer
ERstat is not a medical service. The information provided:
- Is for informational purposes only
- Should not be used to make medical decisions
- Does not replace professional medical advice
- May not be accurate, current, or complete
Always follow the advice of healthcare professionals. In a medical emergency, call 911 or go to your nearest emergency room regardless of posted wait times.
4. Data Accuracy
Wait time information comes from two sources:
- Official data: From provincial health authorities (e.g., NS Health). We display this data as provided but cannot guarantee its accuracy.
- Community reports: Submitted by users. This data is unverified and may be inaccurate.
We clearly distinguish between official and community-reported data in the interface. Use your judgment when making decisions based on this information.
5. User Accounts
When you create an account, you agree to:
- Provide accurate information
- Keep your password secure
- Notify us of unauthorized account access
- Accept responsibility for all activity under your account
6. User Conduct
You agree not to:
- Submit false or misleading wait time reports
- Attempt to manipulate or game the system
- Harass other users or post inappropriate comments
- Use automated tools to access the Service excessively
- Attempt to access unauthorized areas or data
- Use the Service for any illegal purpose
We reserve the right to suspend or terminate accounts that violate these terms.
7. Community Reports
When you submit a wait time report:
- You confirm you are at or recently visited the facility
- You agree the report is truthful to the best of your knowledge
- You grant us permission to display and use the report
- Your report may be visible to other users
8. Alerts and Notifications
Wait time alerts are provided on a best-effort basis. We do not guarantee:
- Alerts will be delivered instantly or at all
- Wait time thresholds are accurate when alerts trigger
- SMS or email delivery (depends on carriers and providers)
Do not rely solely on alerts for time-sensitive medical decisions.
9. Intellectual Property
The ERstat name, logo, and original content are our property. Wait time data from health authorities is subject to their respective terms.
10. Limitation of Liability
To the maximum extent permitted by law:
- ERstat is provided "as is" without warranties of any kind
- We are not liable for any damages arising from use of the Service
- We are not liable for decisions made based on information in the Service
- We are not liable for service interruptions or data loss
11. Indemnification
You agree to indemnify and hold harmless ERstat and its operators from any claims arising from your use of the Service or violation of these terms.
12. Changes to Terms
We may modify these terms at any time. Continued use after changes constitutes acceptance. We will notify users of significant changes.
13. Termination
We may terminate or suspend your access at any time, for any reason, without notice. You may delete your account at any time.
14. Governing Law
These terms are governed by the laws of Nova Scotia, Canada. Any disputes shall be resolved in the courts of Nova Scotia.
